 The primary objective of this assignment is to

  • Assess the level of implementation and enforcement of State Anti-Discrimination Laws.
  • Evaluate institutional compliance with the provisions of the laws.
  • Review legal, institutional and governance arrangements established for implementation.
  • Assess the effectiveness of complaint, reporting, referral and redress mechanisms.

The National Agency for the Control of AIDS (NACA) will make available the necessary documents and reports and other information concerning this assignment. ENGAGEMENT OF A LEGAL CONSULTANT TO FACILITATE THE STATE-LEVEL OVERSIGHT, MONITORING AND STAKEHOLDER REVIEW MEETINGS ON THE IMPLEMENTATION OF STATE ANTI-DISCRIMINATION LAWS

1.    Background

Nigeria has made significant progress in responding to HIV, tuberculosis (TB), and malaria through policy reforms, strengthened health systems, and strategic investments. One of the major milestones in the national HIV response was the enactment of the HIV and AIDS (Anti-Discrimination) Act, 2014, which provides legal protection against discrimination based on actual or perceived HIV status in employment, education, healthcare, housing, and other sectors.

To strengthen these protections at the sub-national level, several states have enacted State Anti-Discrimination Laws. These laws establish legal obligations for government institutions, employers, service providers, educational institutions, healthcare facilities, and other stakeholders to prevent discrimination and protect the rights of people living with HIV (PLHIV).

Despite these legislative achievements, implementation of the laws remains inconsistent. Many states continue to experience weak institutional coordination, inadequate enforcement mechanisms, limited public awareness, poor documentation of discrimination cases, insufficient monitoring systems, and inadequate financial and human resources. These challenges continue to undermine equitable access to HIV prevention, treatment, care and support services.

Under the Global Fund Grant, the National Agency for the Control of AIDS (NACA) is implementing interventions aimed at removing human rights-related barriers to HIV services. As part of these interventions, NACA intends to engage a Legal Consultant to provide technical and legal expertise in facilitating the State-Level Legal Oversight, Monitoring and Stakeholder Review Meetings in six selected states, representing the six geopolitical zones, that have enacted State Anti-Discrimination Laws.

  1. Purpose of the Consultancy

The purpose of this consultancy is to provide legal and technical support to NACA in assessing the implementation and enforcement of State Anti-Discrimination Laws through legal oversight, compliance assessments, stakeholder consultations, and documentation of implementation gaps, best practices and recommendations.

  1. Objectives of the Consultancy

The Legal Consultant shall support NACA to:

  • Assess the level of implementation and enforcement of State Anti-Discrimination Laws.
  • Evaluate institutional compliance with the provisions of the laws.
  • Review legal, institutional and governance arrangements established for implementation.
  • Assess the effectiveness of complaint, reporting, referral and redress mechanisms.
  • Review public awareness and dissemination of the laws.
  • Identify legal, policy, institutional and operational barriers affecting implementation.
  • Document good practices, innovations and lessons learned.
  • Facilitate the development of state-specific implementation action plans.
  • Produce high-quality legal oversight reports with recommendations for strengthening the implementation and enforcement of the laws.
  1. Scope of the Consultancy

The consultant will work closely with the NACA Legal Unit throughout the assignment.

The consultancy will cover six (6) selected states, one from each geopolitical zone.

The consultancy shall therefore cover a total of thirty (30) working days during which He/she will:

  • Perform legal review, planning and preparation.
  • facilitate the State Oversight and Stakeholder Review Meeting.
  • Perform legal analysis, report writing and development of the implementation action plan.
  1. Specific Tasks

A. Pre-Meeting Activities

The consultant shall:

  • Review the State Anti-Discrimination Law and related legal instruments.
  • Conduct comparative legal analysis with the HIV and AIDS (Anti-Discrimination) Act, 2014.
  • Review existing implementation reports, policies, guidelines and institutional frameworks.
  • Analyse available documentation on discrimination complaints and enforcement actions.
  • Develop or refine legal compliance assessment tools, monitoring checklists and stakeholder discussion guides.
  • Identify statutory responsibilities of implementing institutions.
  • Liaise with NACA, State AIDS Control Agencies (SACAs), Ministries of Justice and other relevant institutions.
  • Support participant identification and review of the meeting agenda.
  • Ensure technical readiness for the oversight meeting.

B. Facilitation of State Oversight and Stakeholder Review Meetings (Two Days Per State)

The consultant shall:

  • Present the objectives and legal framework for the assessment.
  • Facilitate review of the implementation status of the State Anti-Discrimination Law.
  • Lead discussions on compliance with statutory obligations.
  • Assess institutional coordination and governance arrangements.
  • Review complaint handling, reporting, referral and redress mechanisms.
  • Assess awareness and dissemination of the law among implementing institutions.
  • Validate evidence presented by stakeholders.
  • Facilitate identification of legal and institutional gaps.
  • Support the development of state-specific implementation action plans.
  • Document proceedings, key findings and agreed actions.

C. Post-Meeting Activities

Following each meeting, the consultant shall:

  • Prepare a comprehensive State Legal Oversight and Monitoring Report.
  • Prepare a State Implementation Action Plan.
  • Document best practices and lessons learned.
  1. Deliverables

For each of the six (6) selected states, the consultant shall submit the following deliverables:

  • State Legal Oversight and Monitoring Comprehensive Report, including findings on the implementation and enforcement of the State Anti-Discrimination Law.
  • Documentation of best practices and lessons learned.
  • Attendance documentation.
  1. Duration of the Consultancy

The consultancy shall be undertaken over thirty (30) working days. The specific dates and sequence of activities for each state shall be agreed with  Legal Unit NACA.

  1. Reporting and Supervision

The consultant shall report directly to the Head of the Legal Unit, National Agency for the Control of AIDS (NACA), who shall provide overall technical oversight and guidance throughout the assignment.

  1. Required Qualifications and Experience

The consultant shall possess:

  • Bachelor of Laws (LL.B) and Barrister-at-Law (B.L.)-30 Marks
  • Minimum of seven (7) years’ post-qualification professional experience. –10 Marks
  • Demonstrated experience in legal and policy analysis, human rights programming, public health or HIV-related legal interventions. (evidence by letter of invitation, participation, report communication etc)-20 Marks
  • Strong knowledge of Nigeria’s HIV and AIDS (Anti-Discrimination) Act, 2014, State Anti-Discrimination Laws and applicable human rights frameworks.
  • Demonstrated experience working with government institutions, development partners, civil society organisations and other relevant stakeholders in the areas of human rights, HIV, public health, law and policy.-  (evidence by letter of invitation, participation, report communication etc)   10 Marks
  • Excellent communication, coordination and stakeholder engagement skills.
  • Workplan and Methodology of approach- 30 Marks

The financial proposal shall specify a total lump sum amount in Naira.

The detailed Proposal must be in English Language and submitted in two (2) hard copies each (one original & two copies) of the requested documents and proposal. The documents shall then be enclosed and sealed in one (1) single outer envelope, and clearly marked at the topmost right corner “Engagement Of A Legal Consultant To Facilitate The State-Level Oversight, Monitoring And Stakeholder Review Meetings On The Implementation Of State Anti-Discrimination Laws” and the Name, Address, Email and Phone Number of the Consultant boldly written at the back of the envelope, with acknowledgement to NACA office at the address below.

Deadline for Submission: The deadline for the submission of proposal should not be later than Thursday 12 noon of 22nd October,2026. The submission(s) received will be opened immediately after closing at NACA Conference Room in the presence of consultants that choose to attend.

The personnel of the Purchaser and the Consultants shall adhere to the highest ethical standards, both during the selection process and throughout the execution of the contract. In pursuance of this principle, they shall abstain at all times from corruption or fraudulent practices. Corruption and fraudulent practices are defined as follows:

 

(i)        “corrupt practice” means the offering, giving, receiving, or soliciting, directly or indirectly, of anything of value to influence the action of an official in the selection process or in contract execution;

(ii)       “fraudulent practice” means a misrepresentation or omission of facts in order to influence a selection process or the execution of a contract;

(iii)           “collusive practices” means a scheme or arrangement between two or more consultants with or without the knowledge of the Purchaser, designed to establish prices at artificial, noncompetitive levels;

(iv)          “coercive practice” means harming or threatening to harm, directly or indirectly, persons or their property to influence the procurement proceedings, or affect the execution of a Contract.

(v)            The Purchaser shall reject a proposal for award if it determines that the Supplier recommended for award has, directly or through an agent, engaged in corrupt, fraudulent, collusive or coercive practices in competing for the contract in question.
